Judge Enters Summary Judgment in FMLA and ADA Action

Andrew Baugher and Cathy Welsh defended Valley Health System in federal court in this employment action arising from an administrative assistant’s claim that she was terminated in retaliation for taking FMLA leave and in violation of the ADA. The employee sought an award of damages exceeding $300,000. The hospital system had actually terminated this employee after a history of poor performance and because she had been accessing her supervisor’s email account and reading emails about her own personal personnel situation without permission. The court granted summary judgment for the defense less than one month prior to trial. Andrew Baugher, lead trial counsel said, “Although we were looking forward to our day in court, we are ecstatic that the court dismissed this action short of trial and in the hospital’s favor. We are confident that a jury would have returned the same decision.”

Jennifer Shirkey Tapped to Dance for Charity

Lenhart Pettit has a strong tradition of giving back to the community. This fall, our own Jennifer Shirkey will be carrying on that tradition as one of seven local celebrity "stars" in the fifth annual Dancing with the Stars of the Burg competition. This premiere local fundraising event benefits Harrisonburg Rockingham Child Daycare Center (HRCDCC). HRCDCC is a nonprofit organization that has been providing care for children regardless of the family's financial resources since 1971. Jennifer has been matched with Carlos Coronado as her pro partner to dance the Paso Doble, and this year's show has a Broadway theme. Cathy Welsh gave a presentation to the Shenandoah Valley Society for Human Resources Management (SVSHRM) regarding the Equal Employment Opportunity Commission’s recently issued Pregnancy Discrimination Guidance. Through this guidance the EEOC significantly expanded employer obligations to accommodate pregnant employees. Legal challenges to the guidance are expected.

Lenhart Pettit raises 17,851 pounds of food during Legal Food Frenzy

The statewide Legal Food Frenzy is an annual competition between law firms and legal organizations to raise funds and food for the Federation of Virginia Food Banks. During this year’s 8th Annual Legal Food Frenzy, Lenhart Pettit raised the equivalent of 17,851 pounds of food, the second highest amount in our region, for the Blue Ridge Area Food Bank, which provides emergency food assistance to families in our local area. Andrew Baugher and Kelly LaPar coordinated Lenhart Pettit's participation in this year's Legal Food Frenzy.
